The website Lithothérapie en Ligne, published by the company Neosis LTD and hosted by the company 1&1 IONOS, with the domain name www.lithotherapie.net registered with the company OVH, aims to provide information, products and services related to crystal healing (lithotherapy), stones and crystals, and the use of minerals for well-being, recreational or collecting purposes.

These terms and conditions of use and sale govern the relationship between the site’s users and customers (hereinafter referred to as “Users” or “User”) and the publishing company Neosis Limited (hereinafter referred to as the “Site”, “www.lithotherapie.net”, “Lithothérapie.net” or “Lithothérapie en Ligne”), whose registered office is located at Room 607, Yen Sheng Centre, 64 How Yuen Road, Kwon Tung, registered with the Hong Kong Companies Registry under number 2277788, when browsing the site and using its features (such as posting comments, creating an account or subscribing to the email newsletter via a form) or purchasing products (such as stones, crystals, minerals, jewelry and accessories) from its e-commerce store.

Using this site, including simply browsing it, and purchasing a product through its online store imply unreserved acceptance of these terms and conditions of use and sale, which the user acknowledges having read in full. The site reserves the right to modify these terms and conditions. If the user does not accept these terms, they must refrain from any use of the site and its services.

Products and items offered for sale

The products offered by Lithothérapie en Ligne are those listed at www.lithotherapie.net/boutique/ while stocks last. The site reserves the right to change the assortment of products offered at any time. Each product is presented on the site in the form of a description outlining its main characteristics and, in the case of healing stones and crystals, a description of the properties traditionally attributed to them or ascribed to them by crystal healing specialists.

Except for one-of-a-kind pieces, which are individually photographed, product photographs are for illustrative purposes only and do not directly represent the actual product as it will be shipped. The natural variations of minerals are an unpredictable factor that must be understood and accepted by the user of the site and its services before any transaction. The product received may, by definition, differ from the photograph shown on the product page. This difference is minimized in the case of one-of-a-kind pieces, whose photographs on the site are a direct representation, but it may nevertheless exist. Consequently, and although we strive to produce photographs that are a faithful representation of the product, these photographs in no way engage the liability of Lithothérapie en Ligne.

Product prices and shipping costs

The prices shown on the product pages of the site’s store are set in Euros (€), all taxes included. Lithothérapie en Ligne reserves the right to change its prices at any time, without prior notice, it being understood, however, that the price shown in the catalog and calculated (barring error) by the e-commerce store software at the time of the order will be the only one applicable to the buyer. The prices shown do not include delivery costs, which are charged in addition to the price of the products purchased, depending on the total amount of the order.

In mainland France, shipping is free for any order exceeding the minimum amount required to qualify for free shipping. This minimum amount is shown as a notice on the www.lithotherapie.net/panier page for users located in France, and is automatically applied on the checkout page when the required conditions are met. This minimum amount can also be obtained simply on request by writing to us at [email protected].

Orders, user account and payment methods

When placing an order, the user must create an account on the www.lithotherapie.net site, which will allow them to store and access various data described in the “Notices regarding the personal data collected by the online store” above. The creation of this account is automated. A username and password are automatically generated and sent to the user by email. The user can then access their account at www.lithotherapie.net/mon-compte, where they can find their order information or edit the information stored on this account. This account can be accessed from the “My Account” tab located in the horizontal menu at the top of every page of the site, where the user can enter the username and password previously sent by email.

While browsing the store, the user can navigate the site’s various product pages and add products to their cart in preparation for their order. They can modify or cancel this order at any time by accessing their cart and changing the product quantities or removing products from their cart. The total amount of the order is displayed on the cart page and then on the checkout page, to which the shipping costs must be added, calculated according to the geographical location of the order’s recipient (at the user’s billing address, or at their shipping address if the user wishes to ship the order to a different address).

On the checkout page, the user can enter and edit their contact details. They then choose their payment method and must accept these Terms and Conditions of Use and Sale before being able to finalize their order and complete their payment.

When the user chooses to pay for their order using the payment method entitled “Credit Card or PayPal Account” (implemented through the PayPal Express Checkout service), they are redirected to PayPal’s secure interface in order to log in to their PayPal account or enter their personal credit card details. If the payment is accepted, the order is recorded and validated, and the user is then redirected to the www.lithotherapie.net site, where they can see their order confirmation. An email containing the information related to the creation of their order is then sent by the website. Another email is sent when the order is being prepared, and yet another when it has been shipped.

Confirming an order implies acceptance of these terms of sale, acknowledgment of having full knowledge of them, and waiver of the right to rely on one’s own purchasing terms. All the data provided and the recorded confirmation will serve as proof of the transaction.

Affiliate program

As part of partnerships with professionals, Lithothérapie en Ligne has an affiliate program granting a commission on sales to business introducers, available at www.lithotherapie.net/programme-affiliation.

This program is subject to approval by the site and may not be used for personal purchases in the store. Promotion of the store must comply with good practices and may not include techniques such as spam or any other objectionable strategy likely to tarnish the site’s image. Any breach of this policy may lead to the suspension of the affiliate account and its potential earnings.

Partner earnings are paid upon issuance of an invoice, starting from a minimum amount and after an order confirmation period, both indicated in the affiliate area of the program’s participants.

Right of withdrawal

Pursuant to Article L121-20 of the French Consumer Code, buyers have fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for an exchange or refund without penalty, with the exception of return shipping costs.

Delivery and shipping address

Deliveries are made to the address indicated on the order form. This shipping address is by default identical to the billing address, unless the user has chosen to ship their order to a different address, in which case the order will be delivered to that address. This address may only be located within the geographical area agreed upon when the order was placed. Orders are shipped by La Poste or by La Poste via COLISSIMO, a tracked delivery service where parcels are handed over without a signature. Delivery times are given for information purposes only. The buyer’s order is delivered to their home by their mail carrier. If the buyer is absent, they will receive a delivery notice from their mail carrier, allowing them to collect the ordered products from the nearest post office within the period indicated by the postal services. Transport-related risks are borne by the purchaser from the moment the items are handed over to La Poste or to the carrier. Upon delivery, the buyer is required to check, in the presence of the La Poste agent or the delivery person, the condition of the packaging of the goods and their contents. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Limitation of liability

Lithothérapie en Ligne, in the distance selling process, is bound only by a best-efforts obligation. It cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, service interruption or other unintentional problems.

Satisfaction guarantee

All products supplied by Lithothérapie en Ligne are covered by the legal warranty provided by law. If a product sold proves to be non-compliant, it may be returned to Lithothérapie en Ligne, which will take it back, exchange it or refund it.
